    At PossibleNOW, we know you care about your personal privacy and about the terms and conditions that govern your use of this website (this “Site”) and our use of any personal information that you or a third party provide to us. This Privacy Policy and the Terms of Use for the Site detail our policies with respect to the handling of personal information submitted by you or otherwise collected by PossibleNOW via the Site. PossibleNOW will use and disclose your personal information only in accordance with the terms in this Privacy Policy and the Terms of Use. This Privacy Policy applies to PossibleNOW, Inc. and its subsidiaries, CompliancePoint, Inc., PossibleNOW Data Services, Inc., and PossibleNOW Services, Inc. (the “Subsidiaries”), and to the following domains (the "PossibleNOW Sites"):

    All references to the Site in this Privacy Policy shall include the PossibleNOW Sites. This Privacy Policy does not apply to data provided to us by our customers under services agreements or vendors under data sourcing agreements. The policies governing the use of such data are covered within the specific agreements related to such data and services. PossibleNOW’s subsidiary, PossibleNOW Data Services, Inc., (“PNDS”) makes certain data licensed from third parties available to its customers for use by such customers consistent with the terms of the license under which such third-party data is provided to PNDS.  That third-party data may contain personal information about you.  To the extent that such data includes any of your personal information, that information is made available to certain PNDS customers (e.g. third party digital marketers, advertising partners, third parties operating in the ad tech sector, etc.) to enable such customers to market products and services to you via online and offline marketing activities based on your interests.  When third parties are given access to such personal information, PNDS takes appropriate measures to make sure that any such personal information is processed only to the extent that such processing is consistent with this Privacy Policy and in accordance with applicable law and the license under which such data was acquired by PNDS.     Personal information is data that can be used to identify a single person and information about that specific person

    You may be asked to provide certain personal information when you interact with PossibleNOW or our Subsidiaries. We collect personal information on the Site when users fill out information request forms, send us an email, or contact us by telephone. PossibleNOW may store the inquiries and the contents of such inquiries including any personal information the user may have provided. Any personal information submitted by you via an inquiry is collected only with your knowledge and consent

    When you download content from our Site, contact us, or participate in an online survey, we may collect personal information such as your name, company, mailing address, country, phone number, email address, and communication preferences.

You may also reply to the e-mails and type the words "REMOVE ME" in the subject line before sending. Your e-mail address will be removed from further e-mailings of marketing materials.

    You may send access, correction, or deletion requests by emailing us at privacy@possiblenow.com. We will honor your request to delete your data unless PossibleNOW is required to retain it by law or has other legitimate business needs to retain it.

  • Information Sharing

    Except as noted above, PossibleNOW does not sell your personal information to third parties. We may provide your information to third parties or service providers solely to process information on our behalf or provide a service to us, such as fulfilling a direct mail piece or email to our customers; however, PossibleNOW requires that these third parties comply with PossibleNOW's privacy policies when processing this information. We may be required to share personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

    Retention of Personal Information
    We will retain your personal information only: 1) for the period necessary to fulfill marketing or service-related communications, 2) until your contact information is no longer valid, or 3) until you request to have your information deleted (unless we have a legitimate business reason or are required by law to retain it).

  • Use of Cookies and Web Beacons and Site Tracking

    A "web beacon" or “clear GIF” is a transparent pixel image used in collecting information about website usage, email response and tracking. Web beacons are used to enhance functionality on the Site (e.g. user ID and password prompts) and aggregate traffic data (e.g. what pages are most popular).

    A "cookie" is a small text file that a website can place on your computer's hard drive in order, for example, to collect information about your activities on the Site or to make it possible for you to download educational content without having to reenter your contact information.     PossibleNOW uses third party applications including, but not limited to, Google Analytics and HubSpot, , which may use web beacons or clear GIFs to track visitors on any of our Sites. We automatically collect and store; the name of the domain and host from which you access the Internet; the Internet protocol (IP) address of the computer you are using; the browser software you use and your operating system; the date and time you access our Sites; and the Internet address of the website from which you linked directly to our Sites.

    We use this information as anonymous aggregate data to determine the number of visitors to different sections of our Sites, to ensure the Sites are working properly, and to help us make the Sites more useful.

    If a Site visitor provides us with contact information through a form submittal, we know the identity of the Site visitor and can track and record information about which pages on our Site the Site visitor views, which helps us provide more relevant information based on their apparent interests.

  • Protecting Your Personal Information

    To protect the privacy and security of customer-owned data and personally identifiable information you transmit through use of this Site, we maintain physical, technical, and administrative safeguards.     User agrees that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the laws of the state of Georgia.

  • Privacy Policy Updates

    We reserve the right to amend the Privacy Policy at any time and for any reason, without notice to you, other than the posting of the amended Privacy Policy. Users should check this Site to see the current Privacy Policy that is in effect and any changes that may have been made to it. The provisions contained herein supersede all previous notices or statements regarding our privacy practices and the terms and conditions that govern them.

  • European Union (EU), United Kingdom (UK), and Swiss data subjects:

    As an entity operating in global markets PossibleNOW and its Subsidiaries will receive personal data from EU, UK or Swiss individuals. PossibleNOW has developed policies and practices to comply with the requirements of the European Union General Data Protection Regulation (GDPR) and the desires of EU, UK and Swiss individuals to have choice and control over how their personal information is used. With respect to EU, UK and Swiss individuals, we will attempt to identify EU, UK and Swiss visitors to our Sites, and, if so identified, subject any personal information that you give us to the requirements of the GDPR.

  • By policy, we will only collect personal information if we have your consent or a legitimate interest to do so.
  • PossibleNOW will only send sales and marketing information to EU, UK and Swiss data subjects if they have provided express consent to do so on a web form or through an email requesting such information, verbally over the phone, or face-to-face at a tradeshow.

  • PossibleNOW complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. PossibleNOW has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. PossibleNOW has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. To learn more about the Data Privacy Framework (DPF) program, and to view our certification, please visit https://www.dataprivacyframework.gov/.  PossibleNOW is subject to the investigatory and enforcement powers of the US Federal Trade Commission (FTC).

  • Accountability for Onward Transfer: If you are an EU, UK, or Swiss Individual, where we transfer your personal data to third party service providers (see above) who perform services for us or on our behalf, we are responsible for the processing of that data by them and shall remain liable if they process your personal data in a manner inconsistent with the EU-GDPR, UK-GDPR, or Swiss-FADP, as applicable, or the DPF Principles referred to above, unless we prove that we are not responsible for the event giving rise to the damage.
  • If personal data covered by this Privacy Policy is to be used for a new purpose that is materially different from that for which the personal data was originally collected or subsequently authorized, or is to be disclosed to a non-agent third party in a manner not specified in this Policy, PossibleNOW will provide you with an opportunity to choose whether to have your personal data so used or disclosed. Requests to opt out of such uses or disclosures of Personal Data should be sent to us as specified below.
  • PossibleNOW is committed to fully complying with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF Principles:
    • We have described above the types of personal data we might collect from EU, UK and Swiss individuals, the purposes for which we collect the data, the third parties with which we share such data and our purposes for doing so.
    • As noted above in the GDPR section, for EU, UK and Swiss individuals, we honor your “right of choice” with respect to your data by offering a number of opt-in and opt-out mechanisms. We honor your right to access, correct, or obtain a copy of any personal information that we have collected on you, and to request that we delete such information.
    • In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, PossibleNOW commits to resolve DPF Principles-related complaints about our collection and use of your personal information. EU individuals, UK individuals and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF should first contact PossibleNOW at: privacy@possiblenow.com or you may also mail us at the address listed above.
    • In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, PossibleNOW commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF to the International Centre for Dispute Resolution/American Arbitration Association (ICDR-AAA), an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment (within 45 days) of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://go.adr.org/dpf_irm.html for more information or to file a complaint. The services of ICDR-AAA are provided at no cost to you. If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration.
